This End User License Agreement ("EULA") is a legal agreement between you and Duni & Friends regarding your use of the Duni & Friends mobile application and any related documentation (the "Application"). By installing or using the Application you agree to this EULA. If you do not agree, do not install or use the Application.
1. License grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on any Apple- or Google-branded device that you own or control, as permitted by the Apple App Store and Google Play usage rules, for personal, non-commercial family use.
2. Restrictions
You may not, and may not permit others to:
- copy, modify, or create derivative works of the Application;
- reverse-engineer, decompile, disassemble, or attempt to derive source code, except to the extent that such restriction is expressly prohibited by applicable law;
- rent, lease, lend, sell, redistribute, or sublicense the Application;
- remove or alter any proprietary notices.
3. Consent to use of data
We do not collect personal data from children. Limited subscription-receipt data is processed as described in the Privacy Policy.
4. Services from third parties
The Application may use third-party services (Apple, Google, RevenueCat) to validate purchases. Your use of those services is governed by their own terms.
5. Termination
This EULA is effective until terminated by you or us. Your rights under this EULA terminate automatically without notice if you fail to comply with any of its terms.
6. No warranty
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED FIFTY US DOLLARS ($50).
8. Export
You may not use or export the Application except as authorized by United States law and the laws of the jurisdiction in which it was obtained.
9. Apple-specific terms (if obtained via the App Store)
- This EULA is between you and Duni & Friends only, not Apple. Duni & Friends is solely responsible for the Application.
- Apple has no obligation to furnish maintenance or support services with respect to the Application.
- In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Duni & Friends is solely responsible for any product liability, legal-compliance, and third-party intellectual-property claims related to the Application.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
10. Governing law
This EULA is governed by the laws of Delaware, USA, without regard to its conflict-of-law provisions, subject to any mandatory consumer-protection laws of your country of residence.
